RULES OF THE CONTEST "CASTING LUZTIQUE" OF THE brand LUZ COLLECTIONS
May 23 to June 5, 2019
ARTICLE 1: DEFINITIONS
In the context of these Rules, the following expressions shall have the following meanings: -
"Contest": means this online contest entitled "CASTING"; - "Participant" or "you" means any person who meets the conditions of Article 4 below and who participates in the Contest;
- "Site" will refer to the website accessible at the following URL address: www.luzcollections.com
- "Organizing Company" where "we" will designate the company LUZCOLLECTIONS designated in Article 2.
ARTICLE 2: ORGANIZATION
The company LUZ COLLECTIONS, SAS with a capital of 12550 €., whose registered office is located at 32 RUE JASMIN 75016 PARIS, acting for its brand " LUZ COLLECTIONS ", hereinafter referred to as the "Organizing Company" organizes a free contest without obligation to purchase, entitled "CASTING" accessible only on the Facebook page of the brand according to the terms described in these regulations.
ARTICLE 3: DURATION AND COMMUNICATION OF THE COMPETITION
The Contest takes effect from May 23, 2019 and runs until June 5, 2019 at 11:59:59 p.m. (date and time of connection of metropolitan France as proof). The Contest will be announced by the following means: - on the Facebook® page of the Organizing Company www.facebook.com/luzcollectionsorganic/. It is understood that the operation is neither managed nor sponsored by the company Facebook®. The latter can in no way be held responsible for any dispute related to the Contest, and the information of the Participants is not transmitted to Facebook®. - by sending an email to customers or subscribers registered in the database of customer files or the newsletter of the Organizing Company.
The contest takes place exclusively on Facebook, any other method of participation (including by post) is excluded.
ARTICLE 4: CONDITIONS OF PARTICIPATION
4.1. The Contest is free of charge and without obligation to purchase.
4.2. Participation in the Competition is open to any natural person residing in Ile-de-France and meeting, on the opening date of the Competition, the following cumulative conditions (hereinafter): - be over 18 years of age; - have internet access (fixed or mobile); - have an email address; - be present and available on 10/06/2017 between 09:00 and 18:00 to participate in the vicinity of Paris in the Shooting Day. Are excluded from any participation in this Contest: - employees and partners of the organizing company, - any person who has directly or indirectly collaborated in the design, organization of the Contest, its realization, implementation, promotion, management or animation.
4.3. Only one entry is allowed per person (same surname, first name and same email address) and the Participant may under no circumstances play on behalf of other people. If it is found that a participant has registered several times, these will be considered null and void. Any participation initiated with a temporary email such as @yopmail.com, @jetable.net, @jetable.com, @jetable.org, @spambox.us will not be considered valid and will be excluded. Any use of different identities for the same participant will be considered an attempt at fraud resulting in the final elimination of the participant for the final draw.
4.4. To participate in the Contest, the Participant must complete the steps described in Article 5 no later than May 30 at 11:59:59 p.m. Each participant undertakes to collaborate in good faith and to transmit complete and accurate information to the organizing company.
4.5. The Organizing Company reserves the right to check the accuracy of the information obtained from participants. Any entry made contrary to the provisions of these rules will render the entry invalid. Any participant suspected of fraud may be excluded from the contest by the "Organizing Company" without the latter having to justify it. Any identification or participation that is incomplete, erroneous, intentional or not, or carried out in a form other than that provided for in these rules will be considered null and void.
ARTICLE 5: PRINCIPLE OF THE COMPETITION
The principle of the competition, organized in the form of a casting, is to recruit 10 Luztiques who will participate and pose for a digital campaign of the Spring/Summer 2019 collection. After validation of their participation, they will be invited to the shooting on Saturday, June 10 and will receive as a gift the products worn during the shooting. They will also receive a 30% discount valid for 1 year on the www.luzcollections.com website.
5.1. Conduct of the game The "CASTING" contest is composed of five phases:
Phase 1. Registration and participation in the contest from May 23 to June 5, 2019, at 11:59:59 p.m. Participation is exclusively via the brand's Facebook page. To participate in the Contest, it is necessary to have Access to the Internet and a valid email address and to perform the following steps: (i) Like the Facebook page @luzcollectionsorganic (ii) Invite two of these friends to participate in the "Casting" Contest (iii) Send your photo to the address (iv) Complete the registration form (surname, first name, age, postal address, email, telephone, profession, knowledge of the casting), accept the rules of the competition and attest to his availability to attend the day of the shooting in Paris on Wednesday, June 12, 2019.
Phase 2. Selection of the 10 Luztiques by the jury LUZ COLLECTIONS, which will designate the winners from among all the participants respecting the conditions of these rules and having duly completed the application file. The winners will be selected on the relevance of their application. The criteria taken into account will be related to the beauty profile, quality of the staging of the photo, imagination, originality, sincerity, humor and photogenics. Phase 3. Announcement of the 10 selected participants on June 6. The names of the 10 selected winners will be announced on June 6 on the Facebook® page of the organizing company www.facebook.com/luzcollectionsorganic/.
Phase 4. Participation in the day of the shooting at 9am on June 12, 2019. During the day, the winners will participate in a photo shoot (series of ten (10) photos maximum) and videos (lasting three (3) minutes maximum) intended to animate the news of the brand on the Internet and social networks. They will be invited to lunch with the LUZ COLLECTIONS team. The swimsuits worn during the shoot will be offered to them as well as a discount valid for one year on the www.luzcollections.com website. The winners must be present and available from 09:00 to 18:00 on June 12, 2019 at the location of the shooting: Mademoiselle Mouche.
ARTICLE 6: LOTS
Each winner will participate in the day of the shoot that will take place in Paris, then will receive the swimsuits worn during the shoot as well as a one-year discount on the www.luzcollections.com site. Each prize is nominative and cannot be awarded to anyone other than the winner. It is understood that the Organizing Company reserves the right, in the event of problems related in particular to its suppliers, to substitute at any time the proposed prize, another prize of equivalent value, and this, without the winner being able to claim any compensation as a result of this substitution. 6.1. SHOOTING DAY IN PARIS ON JUNE 12, 2019 : This casting does not include: - The costs of transporting the Winner from his home to the point of departure and from the point of arrival to his home, - Insurance (luggage, cancellation, delay, assistance and repatriation ...) - The maximum value of swimsuits will be 350 € TTC.
ARTICLE 7: DESIGNATION AND INFORMATION OF THE WINNERS
7.1. The jury will meet on June 6, 2019 and will designate the 10 winners on the relevance of their application file and the validation of the conditions of participation set out above. 7.2. The selected winners will be notified on June 1st by the Organizing Company by telephone and via the sending of a confirmation e-mail and must respond within 72 working hours to confirm their title of "MODEL" and their postal details. If they are found not to meet the criteria of these Regulations, they shall not be awarded the title of MODELE. In this case, the first alternate on the list will then be designated as the winner, subject to the verification detailed above. If the first alternate did not meet the criteria of the Rules, he would not be awarded the title of MODELE. The second alternate would then be deemed to be the winner, subject to the verification detailed above.
The same process will be repeated with the third alternate if the second does not meet the criteria of the Rules. 7.3. The winners who have confirmed the title of "MODELE", will also receive a partnership agreement to be returned to us duly signed by email within 24 working hours. In the absence of the return of the signed agreement within the mentioned deadlines, the title of "MODEL" will be assigned to the next candidate according to the ranking.
ARTICLE 8 - ADVERTISING AND PROMOTION OF THE WINNER
8.1. By the sole fact of the acceptance of their title of "MODEL", the selected winners authorize the Organizing Company, from the obtaining of their title, to use their first name, their city of residence, their profile description as well as their opinions, photographs, videos representing them in all advertising or promotional events related to this Casting, on any type of medium, worldwide, for a period of 5 (five) years, and without this conferring on them any remuneration, right or benefit other than the allocation of its endowment. 8.2. This authorization entails the possibility for the Organizing Company to modify the photographs and/or videos and/or profile description and to bring to the initial fixation any clarification, addition or deletion that it deems useful as long as it does not alter the image or the words of the selected winners. Publications will be subject to moderation and control at the discretion of the Organizing Company.
ARTICLE 9: PERSONAL DATA
According to the law n ° 78-17 of January 6, 1978 relating to Data Processing and Freedoms, each participant has a right of access, rectification or deletion of personal data concerning him with the organizing company. These rights are exercised on simple written request to the following address: LUZ 5 RUE FRANCOIS PONSARD 75016 PARIS In accordance with the regulations in force, the information collected as part of this Game is intended exclusively for the Organizing Company.
ARTICLE 10: LIABILITY
10.1. The responsibility of the Organizing Company is strictly limited to the delivery of the prizes actually and validly won. The Organizing Company cannot be held responsible for the fraudulent use of the rights of connection or allocation of the winner's prize or incur any liability, in the event of force majeure or events beyond its control (including technical problems) disrupting the organization and management of the Casting. In such circumstances, the Organizing Company will inform the Participants via Facebook.
10.2. The Organising Company reminds the Participants of the characteristics and limitations of the Internet network and declines all responsibility for the consequences of the Participants' connection to this network via Facebook. More specifically, the Organizing Company cannot be held responsible for any damage, material or immaterial caused to the Participants, their computer equipment and the data stored therein, and the consequences that may result on their personal, professional or commercial activity. Nor can the Organizing Company be held responsible in the event that one or more Participants are unable to connect to the Site or participate in the game due to any technical defect or any problem related in particular to network congestion or failure, communication interruptions, connection difficulties.
10.3. The selected winners acknowledge and accept that this casting is carried out under their sole responsibility. They acknowledge and accept that they will not be able to benefit from care in case of medical contraindications.
ARTICLE 11: MODIFICATION OR CANCELLATION OF THE CONTEST
11.1. The Organizing Company reserves the right, at any time and by operation of law, without notice or obligation to give reasons for its decision, to interrupt the Contest or to extend or shorten it or to modify or cancel it. In this case, the responsibility of the Organizing Company can not be engaged in any way for this fact and the Participants will not be able to claim any compensation of any kind. Any changes to the Contest rules will be informed as soon as possible on Facebook. 11.2. In the event that one of the clauses of these rules is declared null and void, this shall in no way affect the validity of the regulation itself.
ARTICLE 12: DEPOSIT AND CONSULTATION OF THE REGULATION
12.1. Participation in this competition implies full and unreserved acceptance of these rules. 12.2. These rules can be consulted on the Site for the duration of the Contest.
ARTICLE 13: CONDITIONS OF REIMBURSEMENT OF PARTICIPATION FEES
13.1. The Organizing Company undertakes to reimburse the participant who requests it, the costs incurred to connect to the Site and participate in the Contest and this, within the limit of five (5) minutes of connection per tax household at the reduced rate, i.e. the sum of 0.11 euros for the first minute, and 0.02 euros for the following four (4) minutes. It is specified that some Internet service providers offer a free or flat-rate connection to their Internet subscribers, access to the Contest Site is then made on a free or flat-rate basis (such as cable connection, ADSL ...) and can not give rise to any refund to the extent that the subscription to the services of the access provider is in this case contracted by the Internet user for his use of the Internet in general and that the fact for the Participant to connect to the Site and participate in the Contest does not incur any additional costs or disbursements. The refund request must meet the following conditions: - be sent to us in writing to the following postal address: LUZ 5 RUE FRANCOIS PONSARD 75016 PARIS. The application must be sent no later than June 1, 2017 (as evidenced by the postmark); - indicate your surname, first name and personal postal address; -attach a copy of the detailed invoice of the telephone operator and/or access provider to which you are subscribed, showing the date and time of your connection to the Site and participation in the Competition, as well as a Bank Identity Statement (RIB) or Postal Identity Statement (RIP). 13.2. Any stamp costs that you have incurred in order to send us requests relating to one of the provisions of these rules (request to send payment and/or request for reimbursement of connection costs) will be refunded at the slow rate in force (base 20g), on request. 13.3. Refunds will be made by cheque or by bank or postal transfer, according to our choice, sent within ninety (90) days of the date of receipt of the request, after verification of the merits of the request and in particular the conformity of the information contained in the letter of request for reimbursement with the information recorded on the registration form. Costs whose reimbursement has not been provided for in these rules will remain at your expense. 13.4. Only one refund will be accepted per household (same name, same postal address and/or even RIB or RIP) for the duration of the Competition and within the framework of the Competition only. Any request that is illegible, erased, incomplete or sent out of time will be considered null and void. No refund request can be honored if the conditions indicated above are not met.
ARTICLE 14: APPLICABLE LAW – ATTRIBUTION OF JURISDICTION
These Regulations are subject to French law. To be taken into account any disputes relating to the Game must be made on written request, no later than sixty (60) days after the deadline for participation in the Game as indicated in these Rules, to the following address: LUZ 5 RUE FRANCOIS PONSARD 75016 PARIS.
